Media Consent and Release Agreement

  1. Definitions
     In this Agreement:

    1. “Participant” means the individual taking part in Services provided by Stoked Headquarters Pty Ltd, and where the Participant is under 18 years of age, includes their parent or legal guardian who provides consent on their behalf.

    2. “Media” means all photographs, video recordings, audio recordings, written or digital content, or other visual or audio material in which the Participant appears or is identifiable, created by or on behalf of Stoked HQ in connection with its Services.

    3. “Promotional Use” means use of Media for marketing, advertising, publicity, training, or community engagement purposes by Stoked HQ. This includes, but is not limited to:

      1. Websites managed by Stoked HQ;

      2. Printed or digital marketing materials;

      3. Social Media Platforms;

      4. Presentations, workshops, retreats and events.

    4. “Social Media Platforms” includes, but is not limited to, Facebook, Instagram, TikTok, YouTube, LinkedIn, and any other online or digital channels now in existence or created in the future which Stoked HQ may reasonably use for Promotional Use.

  2. Consent to Use Media

    1. By signing this Agreement, you grant Stoked Headquarters Pty Ltd (ACN 689749264) (“Stoked HQ”, “we”, “us”, “our”) an irrevocable, perpetual, worldwide, royalty-free licence to use, reproduce, adapt, publish, communicate, distribute, edit, and otherwise exploit the Media for Promotional Use. This includes the right to combine the Media with other content, apply edits, or use the Media in part or in full.

    2. Social Media and Third-Party Platforms
       You acknowledge that once Media is published on Social Media Platforms, its use and distribution are governed by the terms and conditions of those platforms, which are outside Stoked HQ’s control. By consenting to Stoked HQ’s use of Media, you accept that Stoked HQ cannot restrict, control, or be liable for how third-party platforms handle or distribute such content.

    3. Participant Sharing of Content
       Where Participants share or tag Stoked HQ in photos, videos, or posts on Social Media Platforms, the Participant grants Stoked HQ a royalty-free, worldwide licence to re-share, repost, or otherwise use such content for Promotional Use.

  3. Waiver of Rights and Release of Liability

    1. You waive any right to inspect or approve the finished Media or its use. You agree that you will not receive payment, royalties, or any other compensation arising from the use of the Media by Stoked HQ.

    2. You release and hold harmless Stoked HQ, its directors, employees, contractors, agents, and assigns from any and all claims, demands, or liabilities in connection with the use of the Media, including but not limited to claims for invasion of privacy, defamation, breach of moral rights, or misuse of likeness, except to the extent prohibited by law.

  4. Revocation of Consent

    1. You may revoke consent at any time by written notice to hello@stokedhq.com.au [LINK]. Revocation will apply to future use only.

    2. Media already printed, published or distributed prior to revocation may continue to be used, and Stoked HQ cannot control or be held responsible for how such Media may have been shared, copied, or redistributed by third parties.

  5. Governing Law
    This Agreement is governed by the laws of Victoria, Australia. Any disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Victoria.


Stoked Headquarters Pty Ltd – Parent/Guardian Media Consent (Minors)

Where the Participant is under 18 years of age, this section must be completed by the Participant’s parent or legal guardian.

By signing this Agreement, I

  • Confirm that I am the parent or legal guardian of the Participant named below;

  • Consent to Stoked HQ capturing, using, and publishing Media of the Participant in accordance with this Media Consent and Release Agreement;

  • Acknowledge that Stoked HQ is not responsible for how third-party platforms (including but not limited to Facebook, Instagram, TikTok, YouTube, and other online platforms) may use or distribute such Media once published;

  • Understand that I may revoke consent by written notice to Stoked HQ at hello@stokedhq.com.au, which will apply only to future use and will not require removal of Media already published or distributed; and

  • Release Stoked HQ from any liability associated with the use of the Participant’s Media, except as required by law.
